1. Purpose
These Special Terms and Conditions Supply SDS (SDS Supplier Agreement) (hereinafter referred to as the “Supply SDS T&C”) apply to customers who use Cobuilder Supply SDS.
The Customer accepts the Supply SDS T&C in addition to accepting the General T&C. Should a discrepancy occur between the provisions of the General T&C and the Supply SDS T&C, the provisions of the Supply SDS T&C prevail.
For matters not explicitly covered in the Supply SDS T&C, the General T&C apply.
Capitalized items as used in the Supply SDS T&C, unless specifically defined otherwise, have the meaning attached to them in the General T&C.
The purpose of these Supply SDS T&C is to regulate the delivery and updating of Safety Data Sheets that suppliers (manufacturers, importers and distributors of chemicals) deliver to the customers of Cobuilder Platform; authorization for the use of chemicals and products as included in the SDS is available in REACH, see https://www.miljodirektoratet.no/ansvarsomrader/kjemikalier/reach/.
2. Delivery and updating of Safety Data Sheets
Safety Data Sheets can be delivered to the Cobuilder Platform in any electronically readable format (pdf, word or similar).
According to the requirements of REACH, the manufacturer, importer and/or marketer must make Safety Data Sheets available free of charge, in paper or electronic form. Supply SDS allows Customer to fulfil the current regulatory requirements regarding the delivery of a Safety Data Sheet, when the Safety Data Sheet has been delivered to Cobuilder Platform in accordance with the regulations.
The Customer warrants and represents to Cobuilder that the content of the Safety Data Sheets uploaded in Supply SDS is accurate, valid and complete in accordance with the applicable law. In the event of changes to the information included in a Safety Data Sheet, the Customer shall ensure that, in accordance with applicable regulatory requirements, an update to the specific Safety Data Sheet is immediately delivered to Cobuilder Platform by its respective supplier.
