Special Terms and Conditions for Cobuilder Require (prev. Link)
This version of the Require T&C applies from 1 April 2025 for new clients and from 1 May 2025 for existing clients.

1. PURPOSE
These Special Terms and Conditions for Cobuilder Require (hereinafter referred to as the “Require T&C”) apply to Customers/ End Users who use the Cobuilder Require product (hereinafter referred to as the SYSTEM). Customers accept the Require T&C in addition to accepting the General T&C. Should a discrepancy occur between the provisions of the General T&C and the Require T&C, the provisions of the Require T&C prevail.
For matters not explicitly covered in the Require T&C, the General T&C apply.
Capitalized items as used in the Require T&C, unless specifically defined otherwise, have the meaning attached to them in the General T&C.
2. ABOUT THE SYSTEM
Cobuilder Require allows Customers to create, edit and share information requirements on construction projects with stakeholders in one common system. Information requirements are based on objects, and properties and documents and can be grouped by milestones, purposes or actors.
The information requirements created in Cobuilder Require are based on construction objects and the corresponding data templates developed in data dictionaries such as Define and buildingSMART Data Dictionary – bSDD (subject to additional licensing). The platform allows export to formats like IDS, Excel, Revit Shared parameter files as well as IFC enrichment and validation. Cobuilder Require integrates with Autodesk Construction Cloud for export of required properties and validation of Revit models.
3. OWNERSHIP RIGTHS
3.1. Own information requirements
The Customer has ownership rights of its Customer Data (Information requirements).
Cobuilder shall not provide data uploaded in Cobuilder Require by the Customer to other customers and Authorized End Users.
3.2. Appointed parties
When using Cobuilder Require, you may be invited by an Appointing Party (project owner) to contribute content to a designated project. By accepting such an invitation, you acknowledge and agree that any intellectual property rights (IPR) or royalties associated with the content you are providing in Require will be owned by the Appointing party (project owner) that invited you. You are not entitled to any IPR or royalties unless expressly agreed upon in writing.
3.3. Workgroup members
Workgroup Members, defined as end-users invited to contribute to a project within Cobuilder Require, hereby acknowledge and agree that any content, data, or information created, submitted, or contributed to projects as part of collaborative efforts or workgroup activities shall be owned exclusively by Cobuilder and its licensors. Workgroup Members expressly agree that they shall have no ownership, intellectual property rights, or proprietary rights over the content they create or submit within Require workgroup activities. All rights, including but not limited to copyright, patent, trade secret, and any other intellectual property rights related to the workgroup contributions, shall vest solely in Cobuilder and its licensors. By participating in workgroup activities within Require, Workgroup Members grant Cobuilder a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, display, and perform the workgroup contributions for the purposes of providing and improving Require. Workgroup Members further agree not to assert any claims of ownership, intellectual property rights, or proprietary rights over the workgroup contributions and hereby waive any such claims to the fullest extent permitted by law. This clause is binding on all Workgroup Members participating in collaborative activities within Require.
