Agreement terms
The Users of Cobuilder Collaborate have, in agreement with Cobuilder, authorized Cobuilder to obtain, on its behalf, relevant Safety Data Sheets and other relevant information (environmental labels, etc.) from manufacturers, importers of chemical products, as well as to act on the user’s behalf vis-à-vis the SUPPLIER as the point of receipt of Safety Data Sheets.
1. Purpose
The purpose of this agreement is to regulate terms and conditions regarding the delivery and updating of Safety Data Sheets that the SUPPLIER must deliver to the USER unsolicited. This is authorized in REACH, see https://www.miljodirektoratet.no/ansvarsomrader/kjemikalier/reach/.
2. About Cobuilder Collaborate
Cobuilder Collaborate has been developed to help the industry’s users of chemical products fulfil their obligations in current chemical legislation and to ensure the right quality of Safety Data Sheets and an efficient flow of information between suppliers and the various actors in the industry. The system also has information on fixed products, which is not permitted in this agreement. Cobuilder Collaborate shall contribute to ensuring that actors can meet the statutory and regulatory requirements relating to the use of chemicals and products, authorized in REACH.
3. Fulfilment of delivery obligation by participation in Cobuilder Collaborate
According to the requirements of REACH, the manufacturer, importer and/or marketer must make Safety Data Sheets available free of charge, in paper or electronic form. The safety data sheet must also be updated without delay. The users of Cobuilder Collaborate have, in an agreement with Cobuilder, confirmed that the SUPPLIER, who either directly or via a distribution link supplies chemical products to the USER, by signing this agreement, has fulfilled the current regulatory requirements regarding the delivery of a Safety Data Sheet, when the Safety Data Sheet has been delivered to Cobuilder in accordance with the regulations. In a letter dated 26 April 2005, the Norwegian Labor Inspection Authority has confirmed that this meets the current regulatory requirements.
4. Delivery and updating of safety data sheets
Safety data sheets can be delivered to Cobuilder Collaborate in any electronically readable format (pdf, word or similar) or the form of data delivered in an XML format determined by Cobuilder.

5.Prices
For suppliers, cooperation in the industry on a common system means a rationalization with regard to the distribution and updating of Safety Data Sheets. On this basis, there is a subscription fee for distributing Safety Data Sheets in Cobuilder Collaborate. For prices, see Appendix 1 to this agreement. Cobuilder may update its standard price list for the platform with 30 days written notice. Exceptions apply to price adjustments on ongoing agreements in accordance with the consumer price index.
6. Duration of the agreement
The agreement lasts 12 months from signing. It is automatically renewed for one year at a time if the agreement is not terminated in writing to the other party within 3 months before the end of the agreement period.
7. Disputes
Any dispute that arises as a result of or in connection with this agreement must be resolved through negotiations. The parties accept the Oslo District Court as the venue for any legal disputes that may arise if the parties cannot resolve disputes through negotiations.
